ESTATE PLANNING

Estate Planning is the process of preparing and signing certain legal documents that direct how your assets should be distributed at your death. Other important estate planning documents name agents, who can make decisions for you during your lifetime, such as a power of attorney. The most common types of estate planning documents are:


  1. Last Will and Testament
  2. Living Trust Agreement
  3. Financial Power of Attorney
  4. Health Care Power of Attorney
  5. Living Will


We work with our clients to explain the purpose of each of these documents and determine which ones will be best for the client. We never pressure clients to pay for documents they do not want. However, we will provide our honest recommendation based upon the client’s estate planning goals.

PROBATE ESTATES

After the loss of a loved one, there are times when the family must go to probate court to transfer certain assets. This process can seem overwhelming. We will work with our clients to prepare and file any necessary probate paperwork, and we will guide the client through the process. The four phases of a probate estate are:


  1. The appointment phase, where someone is appointed as the executor or administrator of the decedent’s estate
  2. The Inventory, which provides the probate court with an itemized list of all probate assets and their date-of-death values
  3. The Accounting, which provides the court with an itemized list of all receipts into and out of the estate
  4. The distribution phase, when the executor or administrator distributes the assets to the beneficiaries.


We also assist the client with filing any final income tax returns for the decedent, or filing income tax returns for the estate, if necessary.

SUBCONTRACTOR WORK FOR LAW FIRMS

Tara provides subcontractor work for a number of law firms in the areas of estate planning and probate estate. She works behind the scenes to prepare documents, speak with the client, and move the process forward for other firms. There is no need for the firm to pay for training, software, salary, benefits, or supplies. Tara is qualified to perform the tasks needed in her practice areas for any Ohio law firm. She has her own probate software or will work with your software. She is proficient in Puritas Springs, Estate Assist, and with the individual probate court forms. She bills the firm an hourly rate, and the firm can then bill an hourly rate of its choice to the client. She invoices monthly.
